These Terms of Use (hereinafter referred to as “these Terms”) apply to any and all conduct when using the service (hereinafter referred to as “this Service”) operated online by niveau Co., Ltd. (hereinafter referred to as “the Company”).
By using this Service, you are deemed to have agreed to all provisions of these Terms. Please be sure to read these Terms before using this Service.
Article 1 Definitions
Unless otherwise specified in these Terms, the meanings of terms used in these Terms shall be as set forth in the following items.
- “This Site” refers to the web pages operated or designated online by the Company under the name “Kaimon.”
- “Vendor” refers to an individual or corporation that has entered into a vendor agreement with the Company and lists products on this Site.
- “Products” refers to the goods sold by a Vendor on this Site.
- “Product Information” refers to product descriptions, images and videos of products, product prices, and other information related to products.
- “Purchaser” refers to an individual who uses this Site to purchase, or attempts to purchase, a product.
Article 2 Scope of Application
On this Site, the conditions of use for this Service are set forth by these Terms and other terms of use. By using this Site, a Purchaser is deemed to have accepted these Terms and all other terms of use in their entirety. In the event of any discrepancy between the provisions of these Terms and the provisions of other terms of use, the provisions of these Terms shall take precedence.
Article 3 Amendment of These Terms
The Company may, at its sole discretion and at any time, amend, add to, or delete provisions of these Terms (hereinafter referred to as “Amendments”) without prior notice. These Terms, as amended, shall take effect from the time they are displayed on this Site. By using this Service, a Purchaser is deemed to have accepted all provisions of these Terms as amended.
Article 4 Modification and Termination of This Service
- The Company may, at its sole discretion and at any time, modify, add to, or delete all or part of this Service without prior notice.
- The Company may, at its sole discretion, terminate this Service at any time.
- The Company shall bear no responsibility whatsoever to Purchasers or third parties for any damages arising from the preceding two items.
Article 5 Suspension of This Service
The Company shall bear no responsibility for any damages incurred by Purchasers or third parties due to suspension of this Service caused by fire, power outages, or similar events. However, the Company shall make its best efforts to restore this Service promptly.
Article 6 Purchase of Products
- Purchasers may purchase products in accordance with the procedures established by the Company.
- Product delivery through this Service is limited to destinations within Japan.
- In the event any issue arises regarding the purchase of a product, the Purchaser and the Vendor shall resolve the matter through discussion between themselves, and the Company shall bear no involvement whatsoever, except as provided in Article 7.
Article 7 Payment of Product Charges
- The product charge shall be the total amount of the product price, shipping fee, and consumption tax as displayed on this Site.
- The method of payment for product charges shall be as separately determined by the Company. Except in the case of payment by credit card, the payment method, due date, and other details shall be notified by email.
- When a product charge is paid by credit card, the Purchaser shall be subject to the terms separately agreed with the relevant credit card company, and neither the Company nor the Vendor shall bear any involvement whatsoever in any dispute between the Purchaser and that credit card company.
- Any fees or other costs associated with payment of the product charge shall be borne by the Purchaser.
Article 8 Handling of Personal Information
The Company and Vendors shall handle Purchasers’ personal information in accordance with the Company’s Privacy Policy (http://www.yomimon.com/privacy/).
Article 9 Viewing, Disclosure, and Other Handling of Information
In any of the following cases, the Company may, to the extent necessary, view, retain, or disclose to a third party information obtained through the operation of this Service, and the Company shall bear no responsibility whatsoever for any damages incurred by a Purchaser or a third party as a result.
- When it is necessary to confirm whether a violation of these Terms has occurred
- When there is imminent danger to a person’s life, body, property, or similar interests
- When a court order or compulsory disposition has been issued under Article 218 of the Code of Criminal Procedure (seizure, search, and inspection under warrant) or other laws and regulations, or when a request for disclosure has been made based on legitimate authority under laws and regulations
- When necessary to resolve a technical malfunction of this Service
- When the Company otherwise determines it necessary for the proper operation of this Service
Article 10 Aggregation and Use of Information
The Company may aggregate or analyze Purchasers’ usage records and use them after processing them so that individuals cannot be identified or specified.
Article 11 Intellectual Property Rights
Industrial property rights, know-how, programs, copyrights, and other intellectual property rights included in the Company’s services, and all rights related thereto, belong to the Company. Except where prior consent has been obtained from the Company, reproduction, sale, or similar use of these is not permitted.
Article 12 Disclaimer
The Vendor shall be responsible for the accuracy and legality of product information, images, and other content published on this Site. The Company shall bear no responsibility whatsoever for any disputes or damages arising from product information or similar content.
Article 13 Governing Law and Jurisdiction
These Terms shall be governed by the laws of Japan. In the event of any dispute concerning these Terms between the Company and a member, the Sapporo District Court shall have exclusive agreed jurisdiction.
Supplementary Provisions
These Terms shall come into effect on July 1, 2015.
